CALIFORNIA CONSUMER PRIVACY ACT (“CCPA”)

  1. RIGHTS FOR CALIFORNIA RESIDENTS

In addition to our general Privacy Policy, if you are a California resident (a person and not a corporation or business entity), you have certain rights. You may ask us to disclose what personal information we have about you and what we do with that information and have the right to be notified on what we do with the information collected about you. You can also ask us to delete your personal information and to not sell your personal information. 

  1. WHAT IS CONSIDERED PERSONAL INFORMATION? 

Personal Information is information that identifies, relates to, or could reasonably be linked with you or your household. For example, it could include your name, social security number, email address, records of products purchased, internet browsing history, geolocation data, fingerprints, and inferences from other personal information that could create a profile about your preferences and characteristics. 

  1. NOTICE AT COLLECTION: WHAT INFORMATION DO WE COLLECT?

Your personally identifiable information may be required for limited purposes of providing you with a confirmation receipt of your signup, registering your information on the Application to advertise to customer users, contacting you in the event of any alleged intellectual property infringement claims; and/or contacting you in the event you want any of your Content needs to be removed from the site.  Personally identifiable information may include but is not limited to: name, address, social security number, e-mail address, telephone number, and IP address. You acknowledge that this information may be personal to you, and by providing Personal Information to us, you allow others, including us, to identify you and therefore you may not be anonymous. The information we gather enables us to enhance user experience.  

  1. THIRD-PARTY SERVICES

In connection with the use of our Service, you may link to other websites, services or social media platforms on the internet and other websites, and we may share your information with third-party platforms such as Stripe, Google Analytics, Paypal, Instagram, Tik Tok, and Facebook.  

  1. HOW DO WE USE THE PERSONAL INFORMATION?

We may use the information you provide about yourself or others for one of the following purposes: (i) to present the Service and its contents to you; (ii) to provide you with information or services that you request from us; (iii) to fulfill any other purpose for which you provide it; (iv) to contact you regarding the Service and/or your account; (v) to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including our billing and collection; (vi) to notify you about changes to the Service or any services we offer or provide through the Service; (vii) to allow you to participate in interactive features of the Service; (viii) to conduct research and development for the improvement of the Service, the development of new services and offerings and in connection with our business; (ix) in any other way we may describe when we provide the information.  Please note that if the Company is acquired, sold, or dissolved, its assets, including personally identifiable information we may possess about you, may, in whole or in part, be sold, disposed of, transferred, divested, or otherwise disclosed as part of the transaction or proceeding. You acknowledge that such transfers may occur and any acquirer may continue to use your Personal Information as set forth in this Privacy Policy. 

  1. SELLING YOUR PERSONAL INFORMATION AND RIGHT TO OPT-OUT

The CCPA defines “sale”  a bit broadly to include information not only in exchange for money but also sharing personal information for something of value (i.e. such as directed advertising, digital analytics, and marketing). We use and sometimes sell your personal information to third-party analytics platforms for purposes of digital analytics and advertising to inform us how we perform online advertising. However, there is transfer of your information that would not be deemed a “sale” under the “service provider” exception of the CCPA. For instance, submitting your information to third-parties who use your personal information solely for the purpose of helping satisfy a business purpose of ours and to further our business purposes, and who contractually agrees to not use or share your data for other purposes will not be deemed a “sale.” To the extent we can contract with such third-party service providers to prevent them from using your personal information outside our intended business purpose, we will seek to do so to comply under the CCPA service provider exception. 

You have the right to opt-out of the selling of your personal information and/or request for us to delete your information. To opt-out of either the sale of your personal information or opt-out using advertising settings, you can click on the “Do Not Sell My Personal Information” link on our website.

  1. RIGHT TO KNOW

You may request that we disclose to you what personal information we have collected, used, shared or sold about you and why we collected, used or sold that information.   1. CCPA RULES FOR MINORS (“RIGHT TO OPT-IN”)

For any users of our Service who are under 13 years of age, a parent or guardian must affirmatively authorize the sale of information. If the users of our Services are between 13 and 16 years of age, you must affirmatively opt-in and authorize the sale of your personal information.
